METROCITY Equipment – TERMS & CONDITIONS
Effective Date: 11/01/2025
By booking with MetroCity Equipment (“Company”), requesting or approving a quote, scheduling service, paying an invoice, signing an agreement, or accepting delivery of equipment, the Customer (“Customer”) agrees to the following legally binding Terms & Conditions.
1. Service Agreement
By placing a booking, Customer agrees to:
• The selected rental service (dumpster, trailer, delivery, smash truck, etc.)
• All pricing and fees listed by MetroCity Equipment
• All rules, limitations, and restrictions in this Agreement
MetroCity Equipment may refuse, delay, or cancel service at any time for safety, access, HOA, permitting, or regulatory reasons.
1A. HOA, Property Manager & Permit Approval
Customer is solely responsible for obtaining any required approvals, permissions, permits, or written authorization from homeowners associations (HOAs), property managers, landlords, municipalities, or governing authorities before delivery.
If delivery, pickup, relocation, or continued placement is delayed, refused, canceled, ticketed, fined, or restricted due to lack of required approval or permit:
• Trip fees apply
• Dry run fees apply
• Relocation fees apply
• Rental time continues
• NO refunds will be issued
MetroCity Equipment is not responsible for HOA violations, citations, towing, or fines related to unauthorized placement.
2. Payment & Security Deposit
Full payment and security deposit are required before delivery unless otherwise approved in writing.
Customer authorizes MetroCity Equipment to charge the payment method on file for all applicable fees, including:
• Overweight charges
• Contamination fees
• Extra days
• Trip/dry run fees
• Relocation fees
• Equipment damage
• Tow/recovery fees
• Landfill surcharges
• Special disposal item fees
• Specialty load fees
• Rainwater weight fees
• Any other unpaid balances
Customer agrees MetroCity Equipment may charge the payment method on file automatically once final costs are determined, without additional authorization.
Unpaid balances may be sent to collections after 30 days.
2A. Payment Method Validity
Customer agrees to maintain a valid, chargeable payment method on file until all charges are finalized. Failure to maintain valid payment information does not relieve Customer of responsibility for outstanding balances.
3. Cancellation Policy
Cancellations made 24+ hours before scheduled delivery may be refunded.
Cancellations made within 24 hours of delivery result in the FULL forfeiture of the security deposit.
Same-day cancellations or refusal of delivery are treated as last-minute cancellations.
3A. Quote Approval & Booking Authorization
Approval of a quote — whether written, verbal, by text, email, message, or implied — constitutes agreement to these Terms & Conditions and authorizes MetroCity Equipment to schedule service.
4. Rental Duration
Each rental includes SEVEN (7) full days per unit unless otherwise stated.
Additional days will be billed at the daily rate shown at the time of booking.
5. Weight Limits & Overweight Fees
Each 13 yard dumpster includes a 1-ton (2,000 lb) weight allowance.
Each 17 yard dumpster includes a 1.5-tons (3,000 lb) weight allowance.
Each 21 yard dumpster includes a 2-tons (4,000 lb) weight allowance.
Overweight charges:
$80 per ton (or portion thereof) above the included tons.
Weight is determined by certified landfill scale tickets, which are final and non-negotiable.
5A. Weight Estimate Disclaimer
Any weight estimate provided by MetroCity Equipment is an estimate only. Final weight is determined solely by the landfill. Customer agrees to pay all overweight charges regardless of estimates.
6. Prohibited Materials
The following items may NOT be placed in any dumpster at any time:
Concrete, brick, dirt, rock, asphalt
Liquids of any kind
Paint, oils, stains, solvents
Chemicals
Batteries
Tires
Appliances containing refrigerant
Asbestos
Propane tanks or gas cylinders
Hazardous waste
Medical or biohazard waste
Animal remains
Anything prohibited by federal, state, or local landfill regulations
Violation of these restrictions will result in contamination fees.
7. Contamination Fee
If prohibited materials or restricted items are found in the container:
$250 Contamination Fee
PLUS
All landfill surcharges, hazardous disposal fees, and any necessary reload/sorting costs.
If the landfill rejects the load, Customer is responsible for:
• Full dump charge
• Reloading cost
• Hazardous processing fees
7A. Special Disposal Items & Additional Fees
Certain items incur additional landfill handling charges. Listed pricing represents minimum charges based on current landfill rates. Actual fees may increase.
Furniture & Bulky Items
• Mattresses – $80 each
• Box Springs – $80 each
• Sleeper Sofas – $100 each
• Recliners / Upholstered Chairs – $60 each
• Sectional Sofa Pieces – $80 per piece
• Hot Tubs / Spas – $300–$500
Appliances
• Washers, Dryers, Stoves, Dishwashers – $50 each
• Water Heaters – $40 each
• Mini-fridges WITHOUT refrigerant – $50–$80
Electronics
• Flat-screen TVs – $40–$80
• CRT TVs – $80–$160
Miscellaneous
• Carpet / padding – $20–$40 per roll
• Toilets – $20–$40
• Fiberglass tubs – $80
Items not listed but incurring landfill surcharges will be billed at landfill rate plus handling.
8. Loading Requirements
Customer agrees to load the container safely:
• Debris must remain level with the top edge
• NOTHING may extend above or outside the container
• Door must be fully closed and latched before pickup
• Heavy materials must be evenly distributed
Customer is responsible for any damages caused by unsafe or improper loading.
9. Delivery, Pickup, Trip & Dry Run Fees
Customer must ensure clear, safe access.
Fees:
Trip / Unable-to-Deliver Fee: $100
Dry Run / Unable-to-Pick-Up Fee: $100
Relocation Fee: $150
Overflow Fee: $150
These fees apply when:
• Access is blocked
• Gate is locked
• Site is unsafe
• Dumpster is overloaded
• Door cannot close
• Incorrect placement instructions are given
9A. Placement Size, Driveway Length & Access Requirements
Dumpster dimensions are approximately 14 ft long by 7 ft wide.
Customer must ensure:
• Minimum 16 feet of straight driveway or placement length
• Minimum 8 feet of usable width
• Adequate turning radius
• Stable, level surface
Failure to meet placement requirements results in trip or dry run fees and continued rental charges.
10. Absolutely NO Moving or Transporting Equipment
This is a strict safety and liability clause:
Under NO circumstance is the Customer allowed to move, lift, drag, tow, haul, pull, push, reposition, or transport ANY MetroCity Equipment dumpster, trailer, or equipment.
This includes:
• Using a vehicle
• Using machinery (tractor, skid steer, forklift, etc.)
• Attempting to tow a trailer
• Dragging or sliding the container
If equipment needs to be moved or repositioned, Customer MUST call MetroCity Equipment.
Unauthorized movement will result in:
• Immediate termination of rental
• Full security deposit forfeiture
• Recovery/Tow Fee: $200 + all tow contractor charges
• Full cost of ALL repairs or replacements
This clause is critical — equipment damage from moving is the #1 issue in the industry.
11. Placement & Property Damage
Customer accepts full responsibility for the placement location.
MetroCity Equipment is not responsible for:
• Driveway scratches, cracks, or scuffs
• Asphalt damage from weight or heat
• Lawn ruts or soil disturbance
• Damage to pavers, stones, or landscaping
• Underground utility damage from normal placement
Customer accepts all risks associated with equipment placement.
12. Recovery & Extraction
If the truck or dumpster becomes stuck due to:
• Soft ground
• Mud
• Sand
• Snow/ice
• Unstable surface
Customer will be charged:
$200 Recovery Fee + any towing/contractor charges.
13. Debris Ownership Transfer
Once the dumpster leaves Customer property:
All contents become property of the landfill and cannot be retrieved.
MetroCity Equipment does not inspect, sort, or separate materials.
Customer is responsible for ensuring no personal items are inside.
14. Weather, Traffic & Operational Delays
Pickup and delivery times are NOT guaranteed and may vary due to:
• Weather
• Traffic
• Landfill delays
• Equipment maintenance
• Driver scheduling
No refunds are issued for scheduling delays.
15. Equipment Theft, Loss, or Damage
Customer is responsible for:
• Theft
• Vandalism
• Fire
• Damage caused by third parties
• Hit-and-run damage
• Tampering
Repair or replacement costs will be billed directly to Customer.
16. Indemnification
Customer agrees to indemnify and hold harmless MetroCity Equipment, its owners, employees, and contractors from any claims, injuries, damages, fines, or losses arising out of:
• Customer negligence
• Failure to follow loading or placement rules
• Prohibited items
• Unsafe site conditions
• Unauthorized movement of equipment
17. Governing Law
This agreement is governed by the laws of the Commonwealth of Virginia.
18. Acceptance of Terms
By booking, paying, signing, or using any MetroCity Equipment service or equipment, the Customer acknowledges they have read, understand, and fully accept these Terms & Conditions.
18A. Failure to Review Terms
Failure to read or review these Terms & Conditions does not exempt Customer from responsibility or payment.
